The terms that apply to your use of Tunedy.

1. Introduction and acceptance
These Terms of Service govern your access to and use of the Tunedy platform (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. Operator identity and contact method
Tunedy is an application of Toonedy Developments, an independent project operated by Jens [FULL SURNAME] in the Netherlands. Toonedy Developments is an unregistered project name and is not an incorporated company or separate legal person. You can contact us through the Contact page.
3. Minimum age
You must be at least 16 years old to create an account and use the Service. By creating an account you confirm that you meet this requirement.
4. Account creation and security
You may need to create an account to access certain features. You are responsible for keeping your account credentials secure and for all activity under your account. Please notify us through the Contact page if you believe your account has been compromised.
5. Description of the service
Tunedy is a listening platform that publishes original audio stories and educational listening experiences. The Service includes progress tracking, Listening Points, achievements and transparent platform statistics.
6. Public-test status
The current version of Tunedy is a public test. Features may be experimental, incomplete or changed at any time. The Service is provided for testing and evaluation purposes during this phase.
7. Listening Points and Test Credits
Listening Points are virtual platform statistics that reflect valid listening activity. Test Credits are virtual test data used to simulate pool values and shares. Rankings and displayed pool values are simulations.
8. No current monetary value
Listening Points, Test Credits, rankings and displayed pool values have no monetary value. Nothing available during the public test can be purchased, sold, transferred, exchanged or withdrawn. Users have no contractual entitlement to payment, and no current activity can create a claim to a future reward.
9. No purchase, sale, withdrawal, transfer or guaranteed conversion
There is no mechanism to purchase, sell, withdraw, transfer or convert Listening Points or Test Credits into money or anything of value. No bank, crypto or payment withdrawals are available.
10. No obligation to launch a future reward programme
Tunedy is not promising that a real-money reward programme will launch. Any future reward programme will require a separate announcement, eligibility rules and updated terms.
11. Separate future terms, eligibility and possible 18+ verification
If a future monetary reward programme is introduced, it may require users to be at least 18 years old, complete identity verification and live in an eligible jurisdiction. Such a programme would be governed by separate terms.
12. Valid-listening requirements
Listening Points are based only on valid listening activity: real, active playback while the player is open and playing. Time is not awarded when the tab is backgrounded or throttled, and skipped portions do not earn points.
13. Prohibited activity
You may not use bots, scripts, automated playback, multiple accounts, background manipulation, emulators, artificial traffic or any other method to inflate activity. Attempting to circumvent the valid-listening controls is prohibited.
14. Investigation and correction of invalid activity
We may investigate activity that appears invalid or automated and may flag, exclude, adjust or reset Listening Points or progress that result from prohibited behaviour.
15. Contact or appeal procedure
If you believe activity was incorrectly flagged or adjusted, you may contact us through the Contact page with relevant details. We will review genuine appeals in good faith.
16. Acceptable use
You agree to use the Service lawfully and respectfully, and not to misuse, disrupt or attempt to damage it. You may use the Service for personal, non-commercial listening.
17. Intellectual property
The Tunedy platform, its design, branding and software, and original Tunedy audio recordings and presentation, are owned by the operator. Details are set out in the Content Licence and Copyright page.
18. Limited personal licence
We grant you a limited personal, revocable, non-exclusive licence to use the Service for your own listening. This does not include any right to download, redistribute or reuse content except as described in the Content Licence.
19. Advertising and third-party services
The Service may display advertising from third parties such as Google AdSense. Advertising is independent from the reward system.
20. Advertisement views and clicks never generate rewards
Advertisement views, impressions, clicks and interactions never earn Listening Points or Test Credits and never affect eligibility. You are never required to view or interact with an advertisement to start, continue or finish an audiobook.
21. Service changes, testing, errors and maintenance
We may change, suspend or discontinue features for testing, maintenance or improvement. The Service may contain errors during the public test.
22. Account suspension and termination
We may suspend or terminate access if these Terms are breached or to protect the integrity of the Service.
23. Account deletion
You can request deletion of your account through the Contact page. We may retain certain data where required by law or as described in the Privacy Policy.
24. Possible reset or loss of public-test progress
Because this is a public test, Listening Points, Test Credits, rankings and other progress may be reset, changed or lost at any time without compensation.
25. Warranty disclaimer
The Service is provided "as is" during the public test. To the extent permitted by law, we disclaim warranties. Mandatory consumer rights under Dutch law remain unaffected.
26. Liability
To the extent permitted by law, our liability is limited. Nothing in these Terms excludes liability that cannot legally be excluded under Dutch law.
27. Governing law
These Terms are governed by Dutch law, preserving any mandatory consumer protections that apply to you.
28. Changes to the terms
We may update these Terms from time to time. The "Last updated" date above indicates when they were last revised.
29. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
